ℹ Scope of This Policy: This Privacy Policy applies exclusively to the Apex Regen Wellness website (the “Site”). It does not govern health information collected through our Electronic Medical Records (EMR) system, PatientNow, which is governed by a separate HIPAA Notice of Privacy Practices provided at the time of treatment.
1. WHO WE ARE
Apex Regen Wellness (“Apex Regen,” “we,” “our,” or “us”) is a mobile intravenous (IV) wellness company operating in the State of New Jersey. We provide IV hydration therapy, vitamin infusions, intramuscular injections, and related wellness services administered by licensed Registered Nurses at client-chosen locations.
Our website (the “Site”) is a cosmetic / informational website only. It does not directly collect, store, or process any personal information or protected health information (PHI). All client account creation, appointment booking, and health data entry occurs exclusively through our third-party EMR platform, PatientNow, which operates its own HIPAA-compliant infrastructure entirely separate from this Site.

2. INFORMATION THIS WEBSITE DOES NOT COLLECT
Because this Site is informational and cosmetic in nature, we want to be transparent about what we do not collect directly through this website:

3. INFORMATION COLLECTED AUTOMATICALLY WHEN YOU VISIT OUR SITE
When you visit our Site, certain technical information may be collected automatically by our web hosting provider and analytics services. This information is used solely for website performance and operational purposes and does not identify you personally.

4.3 — Google's Data Use
Google may use the data collected to contextualize and personalize ads within its own advertising network. This activity is governed by Google’s Privacy Policy, available at https://policies.google.com/privacy. Apex Regen Wellness does not control Google’s data practices beyond the settings available within Google Analytics.
4.4 — Opting Out of Google Analytics

The limited technical and analytics data collected through this Site is used exclusively for the following purposes:

6. PATIENTNOW EMR SYSTEM & HIPAA COMPLIANCE
When you book a treatment with Apex Regen Wellness, you will be directed to create a client account through PatientNow, our third-party Electronic Medical Records (EMR) and practice management platform. All personal information, health history, appointment data, and Protected Health Information (PHI) is collected, stored, and managed exclusively within the PatientNow platform.
6.1 — Separation of Systems
The PatientNow platform is entirely separate from this website. Apex Regen Wellness does not transfer, receive, or store any data entered into PatientNow on our website servers. Our website has no access to, and does not interface with, any data stored in PatientNow.
6.2 — HIPAA Compliance
PatientNow is a HIPAA-compliant platform that operates under the requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R. Parts 160 and 164 (the Privacy Rule and Security Rule). As a covered entity and/or business associate, Apex Regen Wellness and PatientNow maintain appropriate administrative, physical, and technical safeguards to protect your PHI as required by federal law.

6.3 — Notice of Privacy Practices
Your rights regarding your Protected Health Information — including the right to access, amend, restrict use of, and obtain an accounting of disclosures of your PHI — are governed by our separate HIPAA Notice of Privacy Practices, which is provided to you at the time of your first treatment and is available upon request.
6.4 — PatientNow Privacy Policy
The collection and use of data within the PatientNow platform is governed by PatientNow’s own Privacy Policy and Terms of Service, which you will be presented with upon account creation. Apex Regen Wellness is not responsible for PatientNow’s independent data practices beyond the scope of our Business Associate Agreement.
7. DISCLOSURE OF INFORMATION TO THIRD PARTIES
Apex Regen Wellness does not sell, rent, trade, or otherwise disclose any personal information collected through this Site to third parties for commercial purposes. The limited data we collect may be shared only in the following circumstances:

Service Providers: We may share technical data with our web hosting provider and Google Analytics solely to operate and improve our Site. These providers are contractually prohibited from using your data for any other purpose.

Legal Requirements: We may disclose data if required to do so by law, court order, subpoena, or governmental authority, or if we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of Apex Regen Wellness, our clients, or the public.

8 DATA RETENTION
We retain the limited technical data collected through this Site only for as long as necessary to fulfill the purposes described in this Policy:

Server Log Data: Retained for up to 90 days for security monitoring purposes, then deleted.

Google Analytics Data: Retained for 26 months by default within Google’s systems, in accordance with Google Analytics data retention settings. You may opt out at any time as described in Section 4.4.

Cookie Data: Session cookies expire when you close your browser. Persistent analytics cookies expire according to Google Analytics default settings (up to 2 years).
Health and personal information entered into PatientNow is retained in accordance with applicable HIPAA record retention requirements and New Jersey healthcare record retention laws (minimum 7 years from date of service, or until age 23 for minor clients, whichever is longer).
9 . DATA SECURITY
We take reasonable and appropriate technical and organizational measures to protect the limited data collected through this Site from unauthorized access, disclosure, alteration, or destruction. These measures include:

10. CHILDREN'S PRIVACY — COPPA COMPLIANCE
This website is not directed to children under the age of 13, and we do not knowingly collect any personal information from children under 13 through this Site, in compliance with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506.
Apex Regen Wellness does serve clients between the ages of 12 and 17 for IV wellness treatments; however, all such services are provided in person only, with the written consent and physical presence of a parent or legal guardian, as required by our clinical policies and applicable New Jersey law. Minors do not independently create accounts or enter personal information through this website.
If we become aware that a child under the age of 13 has provided personal information through this Site without verifiable parental consent, we will take immediate steps to delete that information. If you believe a child under 13 has submitted information through our Site, please contact us immediately.

13. DO NOT TRACK (DNT) SIGNALS
Some browsers include a “Do Not Track” (DNT) feature that signals websites not to track your browsing activity. Because there is currently no universally accepted standard for how websites should respond to DNT signals, our Site does not respond to DNT signals in a technically differentiated manner at this time.
